Mexico’s Supreme Court endorses legal purchase of cannabis seed

The Second Chamber of the Supreme Court of Justice of the Nation (Suprema Corte de Justicia de la Nación: SCJN) approved that the reform to legalize marijuana for medicinal purposes may also benefit those who want to consume it recreationally.

During the session on Wednesday, July 4, the members of the room, with the exception of Margarita Luna Ramos, who was not present, approved the project that establishes a solution so that the cannabis seed that will be used for recreational purposes can be acquired in a legal manner.

The project was carried out by the minister José Fernando Franco González Salas in an injunction under review promoted by three persons who previously obtained a permit to consume marijuana for recreational purposes, but who did not have authorization to buy the seeds to exercise their right.

The ruling establishes that the Federal Commission for Protection against Sanitary Risks (Cofepris) must issue a special permit for the acquisition or transfer of the seed.

With this, the beneficiaries of the injunction will be able to buy the seed with the producers or drugstores authorized by the Ministry of Health (SSA) according to the reform of 2017 to the General Law of Health by which the use of marijuana was legalized for medicinal purposes and this would prevent the illegal acquisition of the seed.
