On July 12th, the Specialized Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) determined that President Andrés Manuel López Obrador coerced the vote of citizens and improperly used social programs within the framework of the electoral process.

According to this court, during his mornings on May 9 and 11, 2023, the Mexican president violated the principles of impartiality, neutrality, and equity in the contest; He improperly used public resources and social programs.

In addition to coercing the citizen vote, he carried out personalized promotion and disseminated government propaganda during a prohibited period, alluding to Plan C and the need to achieve a qualified majority in the chambers of the Congress of the Union to continue the transformation.

“The improper use of social programs and coercion to vote by the head of the federal Executive Branch exists since he used a line of argument tending to condition the validity or benefits of social programs to a certain political option obtaining a qualified majority in the Congress of the Union,” said the Chamber.

These demonstrations, the Plenary considered, had an electoral impact, since they were calls to vote in favor of one political option and against another, thereby attempting to influence the preferences of citizens.

When resolving a complaint filed by the PRD against the President of the Republic, various people in the public service, as well as against Claudia Sheinbaumun, then head of the Government of Mexico City and the Morena, PT, and PVEM parties, the Specialized Court also estimated the existence of misuse of public resources, since López Obrador used human, financial and material resources at his disposal for the organization, celebration and transmission of the morning conferences and used his social networks to disseminate the President’s expressions in favor of one of the candidates.

Regarding the dissemination of government propaganda during a prohibited period, attributed to the President of the Republic and others, it was also declared to exist, because the demonstrations of the president do not fall within the exceptions of government propaganda that can be disseminated during the campaign. electoral.

Likewise, the then head of Government of Mexico City, Claudia Sheinbaum, was also held responsible for violating constitutional principles, by making statements related to the president’s comments at a press conference.
