The Electoral Court of the Judicial Branch of the Federation determined that there would be no new votes. It recognized Erik Rihani as the winning candidate in the port of Progreso.

The Xalapa Regional Chamber of the Electoral Court of the Judicial Branch of the Federation (TEPJF) determined that the nullity of the elections in the municipalities of Hunucmá, Izamal, and Progreso declared by the Electoral Court of the State of Yucatán (TEEY) did not have sufficient elements to determine this decision, so they revoked this sentence and therefore no new votes will be held.

During the analysis of the file in Puerto Progreso, the Chamber revoked the nullity of the election declared by the TEEY but did not order the victory for Raúl Alvarado Naal, Morena candidate who had been declared with the majority of votes, because the specific annulment of five polling stations where irregularities occurred was addressed.

By annulling these boxes, the vote count changed, giving more votes to Erik Rihani, the PAN candidate. Hence, the Court ordered that his victory be recognized and that he be given a certificate of majority.

“There was no justification for declaring the nullity of the election in Puerto Progreso, Yucatán. I consider that the decision of the Electoral Court was inconsistent with the claims of the plaintiff parties since such an issue was not raised in the original lawsuits… It was the TEEY who introduced the nullity of the election ex officio without justifying that it was in any of the assumptions for them,” said Magistrate Enrique Figueroa.
