The Fourth District Judge in Yucatán granted a new suspension in an injunction promoted by the children of Santa María Chí, ordering the immediate halt of the operations of the pig farm operated by “Chumoxil, S.A. de C.V.”, owned by Oswaldo Loret de Mola Coldwell and Francisco José Loret de Mola Díaz.
This decision responds to the environmental and public health risks posed by swine activity in the area, according to a bulletin from the legal defense of the Mayan community.
The suspension forces the authorities to implement a series of immediate measures, including stopping the introduction of new pigs to the farm, keeping the animals already in the facilities alive, and avoiding infections. In addition, it is ordered to continue with the treatment of wastewater, mitigating environmental damage derived from the presence of the farm.
The judge also orders constant inspections to guarantee compliance with the suspension. Require the company to strictly comply with the court order.
The Judge based his resolution on the impact on the fundamental rights of children, such as access to a healthy environment, clean water, and ecological balance. He also highlighted the “imminent danger” of irreparable damage to the peninsula’s aquifer if the farm continued operating.
Although two previous suspensions had been granted in 2024 under protection 1889/2023, the Mérida City Council renewed the farm’s operating license until August 31, 2027.
This action, according to the court ruling, constitutes a violation of the human rights of children and the community.
However, in a controversial move, the City Council challenged the recently granted suspension, arguing that it does not have the power to order the closure of the farm for alleged environmental violations.
With the suspension in force, the company is obliged to stop all swine activity and guarantee the well-being of existing animals. The responsible authorities must carry out inspections to verify compliance with the order and report any non-compliance to the District Judge.
