INE orders AMLO and Samuel García to delete publications that could violate electoral laws

The Complaints and Complaints Commission of the National Electoral Institute (INE) ordered President Andrés Manuel López Obrador to delete publications from his website and the governor of Nuevo León, Samuel García, to remove videos from social networks, as the materials could constitute improper use of public resources, violation of equity in the race and anticipated campaign events.

This Saturday, the Complaints Commission resolved a complaint against President López Obrador, and those responsible, for the dissemination on the official website of the head of the Federal Executive of the statements made during his visit to Almoloya de Juárez, State of Mexico, on December 10, 2023.

At the event, the president indicated that on June 2 he must not only win the presidency but also the majority in the Congress of the Union because if he does not do so, he warned that the approval of the budget to “help the people” will not be guaranteed.

“It is important to take into account that it is not only about winning the Presidency, you also have to win the majority in Congress because, look, if I win the Presidency, as we won, but we would not have won the majority in Congress, we would be It would have taken more work to help the people, because if you do not have a majority in Congress you cannot have an integrated budget, because the Chamber of Deputies, by law, is the one that has the exclusive power to approve the budget,” indicated the president.

The Complaints Commission declared it appropriate to order the people linked to the management and administration of the website to carry out all the actions, procedures, and procedures necessary to eliminate or modify the publication that contains the stenographic version of the event held in Almoloya de Juarez.

The INE also linked President López Obrador to comply with his order to delete the publication.

On the other hand, the INE also ordered Samuel García, the Citizen Movement party (MC), federal and local deputies and senators of the Republic, as well as the municipal president of Campeche, to withdraw various publications denounced by the PRI, since in them it is noted that the governor of Nuevo León shows his support for the sole candidate for the Presidency of the Republic for MC, Jorge Álvarez Máynez, which is why it is considered that there is a possible transgression of constitutional article 134.

The INE indicated that elements of a political-electoral nature emerge from the content of the reported material, coupled with the fact that it is hosted on the social network of the state public official, which may transcend it to a greater extent since it is accessible to the general public.

Due to the above, the governor of Nuevo León and the MC party were ordered to, within a period that may not exceed 6 hours, remove the reported material from social networks, as well as from any other platform on which it is hosted. .

Likewise, the INE ordered Samuel García to delete from social networks a video against Xóchitl Galvéz Ruiz, PAN-PRI-PRD candidate for president.

Although the Commission determined that the video is protected by the exercise of freedom of expression, it decided to order its elimination, since the reported material is not political, nor is its content generic, so its dissemination is not permitted at all times.
