Owner demands the Yucatan Prosecutor’s Office to hand over the Mayaland hotel in Chichen Itza

Mr. Fernando Barbachano, the owner of the Mayaland Hotel, accuses businessman Rodolfo Rosas Moya of obtaining profits that do not belong to him because he is not the owner.

According to El Universal, a group of lawyers of Fernando Barbachano Herrero, owner of the Mayaland hotel in Chichen Itza, demanded that the Attorney General’s Office (FGE) of Yucatan end the legal dispute of that property with businessman Rodolfo Rosas Moya and comply with the order of the Attorney General of Quintana Roo to hand over physical possession of the place.

Before the Public Property Registry, the Barbachano Herrero family appeared as the owner of the hotel that is more than 100 years old: Barbachano Herrero and his lawyers pointed out that with legal tricks and influences of Rosas Moya, he managed to obtain physical possession of the property for 3 years during which he has been usurping the property and operating the hotel obtaining profits that do not belong to him.

Barbachano Herrero pointed out that the Attorney General’s Offices of Quintana Roo and Yucatan are the ones that have allowed these abuses and even unfounded accusations against him and expressed that both agencies are responsible for responding to the damages to the Mayaland hotel during these 3 years in which Rosas Moya took physical possession and has obtained profits that do not correspond to him.

Gerardo Ostos Rincón Gallardo and Manuel Rodríguez Villamil, the two main lawyers of a group of 12 who work on the Mayaland hotel case, stated that there have been a series of legal aberrations that have been committed “under the protection of power,” and they said that they suspect that the former governor of Yucatan, Mauricio Vila Dosal, is the one who has supported this type of actions in favor of Rosas Moya, such as allowing the creation of a special court approved by the Judicial Council, to deal with this matter.

Ostos Rincón Gallardo assured that it is not legal to create any special court and this was done through the Superior Court of Justice of Yucatan and the magistrate Mario Castro.

Likewise, the lawyer Ostos Rincón Gallardo, pointed out that “he had never seen so many traps used by bandits to deprive Mr. Barbachano of his legitimate property.”

Mr. Fernando Barbachano tried to enter the hotel.

After the press conference, Barbachano Herrero tried to enter the Mayaland Hotel. Two guards asked him to identify himself and he shouted at the top of his lungs: “I am the owner of the hotel.”

However, when the guards refused, he decided to leave to avoid any altercation with them.
